Kommentar med anledning av nyhetsrapportering

Med anledning av nyhetsrapportering den 23 september 2022 vill ISP kommentera följande:

Rapporteringen rör produkter med dubbla användningsområden (PDA). PDA är civila produkter. PDA är under kontroll då de kan användas både för civila och militära ändamål.

I enlighet med EU:s sanktioner mot Ryssland finns begränsade möjligheter till undantag från förbud gällande export för civil användning och civila slutanvändare avsedd för:

• civilt samarbete mellan EU, medlemsstaternas regeringar och Rysslands regering
• mellanstatligt samarbete i rymdprogram
• civilt kärntekniskt samarbete
• sjösäkerhet
• civila elektroniska kommunikationsnät som inte är allmänt tillgängliga och som inte tillhör en enhet som är offentligt kontrollerad eller till mer än 50 % offentligägd
• enheter som ägs eller kontrolleras av EU-företag,
• EU:s, medlemsstaternas och partnerländernas diplomatiska representationer,
• säkerställande av cybersäkerhet och informationssäkerhet i Ryssland, med undantag för landets regering och företag som direkt eller indirekt kontrolleras av regeringen
• export i enlighet med avtal som ingicks före den 25 februari 2022 där ansökan om undantag inkom före den 1 maj 2022.

Undantag kan inte medges till militär slutanvändare eller för militär slutanvändning. Undantag kan inte heller medges för slutanvändning inom luft- eller rymdfart eller energisektorn.

ISP bekräftar de uppgifter som Ericsson AB har uppgett till Sveriges Radio Ekot. Därutöver kan ISP av sekretesskäl inte lämna någon ytterligare kommentar.

With reference to media reporting September 23, 2022 the Inspectorate of Strategic Products (ISP) would like to leave the following comments:

The reporting concerns dual-use items. Dual-use items are civilian products that can be used for both civil and military purposes.

In accordance with the EU's sanctions against Russia, there are limited opportunities for derogations from the export prohibitions. Derogations can only be granted for civilian use and civilian end-users intended for

• cooperation between the European Union, the governments of Member States and the government of Russia in purely civilian matters;
• intergovernmental cooperation in space programmes;
• the operation, maintenance, fuel retreatment and safety of civil nuclear capabilities, as well as civil nuclear cooperation, in particular in the field of research and development;
• maritime safety;
• civilian non-publicly available electronic communications networks which are not the property of an entity that is publicly controlled or with over
  50 % public ownership;
• the exclusive use of entities owned, or solely or jointly controlled by a legal person, entity or body which is incorporated or constituted under the law of a Member State or of a partner country;
• the diplomatic representations of the Union, Member States and partner countries, including delegations, embassies and missions;
• ensuring cyber-security and information security for natural and legal persons, entities and bodies in Russia except for its government and undertakings directly or indirectly controlled by that government;
• exports due under contracts concluded before 25 February 2022 provided that the application for derogation was requested before 1 May 2022.

Derogations cannot be granted for export to military end-users or for military end use. Furthermore, derogations cannot be granted for end-use intended for aviation or the space industry or for the energy sector.
